Every year thousands of Norwegians travel to Spain and invest millions of kroner in a holiday home. The trend shows that most of us prefer to buy in a development that is still under construction. The vast majority then sign a purchase agreement with a Spanish company, often one with Norwegian-speaking staff. IT IS IMPORTANT TO BE AWARE THAT SUCH AN AGREEMENT IS NOT PROTECTED BY THE NORWEGIAN ESTATE AGENCY ACT, WITH THE INSURANCE AND PEACE OF MIND THAT IT PROVIDES.

If the sale goes through a Norwegian-registered estate agency, the statutory insurance must be in place. Eiendomsnøkkelen AS must therefore have – and does have – insurance covering the liability that may arise in carrying out the brokerage service itself in Spain. We are required to provide the necessary security of up to NOK 45 000 000. The Norwegian estate agent must work in accordance with the rules of the Norwegian Estate Agency Act. The Financial Supervisory Authority of Norway (Finanstilsynet) sets clear guidelines for how brokerage abroad, including in Spain, must be carried out. This is also why we only work with developers who provide a bank guarantee for the purchase price.

This means that if we make a mistake that causes you, our client, a financial loss, our Norwegian insurer will cover your loss.

Agreements entered into in Spain outside a Norwegian-registered estate agency are governed by Spanish law on the purchase and sale of properties under construction. Although most purchases go well, uncertainty can arise around the investment, particularly if the developer goes bankrupt or fails to deliver as agreed. The risk is reduced considerably if you buy your holiday home in Spain through a Norwegian estate agency.

Put simply:

You buy a property under construction in Spain subject to the same principles, insurance and security requirements as when you buy a property under construction in Norway.

The necessary bank guarantee is provided by our partner developers' financial institutions, so that security is in place at all times for every amount paid in. In this way your investment is protected against loss should the developer go bankrupt.

All payments are made to a client account in a Norwegian bank. As your estate agent, it is our responsibility to ensure that money is only released to the developer against a bank guarantee for the corresponding amount. This is checked by us and our associate in Spain. Our associate in Spain is a respected law firm that assists us with the legal processes triggered by your purchase of a property in Spain, and whose local knowledge allows them to pick up local rules that we might not.

Professional indemnity insurance with Tryg Forsikring, with cover in Spain

Eiendomsnøkkelen AS brokers property in Spain under Norwegian regulations for the sale of property abroad to Norwegian clients.

Our estate agency work is subject to Norwegian regulations, which require us to provide security and hold financial liability insurance for estate agents. This is arranged through the collective insurance agreement that the Norwegian Association of Real Estate Agents (NEF) holds with Tryg Forsikring.

This insurance has been extended to cover our assignments in Spain as well. If you buy a property in Spain through Eiendomsnøkkelen AS, any agent errors resulting in financial loss to you as our client will be covered by this insurance.

The insurance covers NOK 15.000.000,- per assignment per injured party, with a total of NOK 45.000.000,- during the insurance period.
